Shipping Insurance & Damage/Loss

By not selecting shipping protection, you agree to bear all risks of loss, damage, with no recourse for replacement or refund from Don's Liquors.

At Don's Liquors & Wine, we take great care in packaging our products and inspecting them before shipment to maintain high standards of quality. Despite this, opting out of shipping protection means you accept full liability for any damages to the bottle once delivered or during transit. This applies even when the package is damaged and is returned to us. You are agreeing that you are liable for this if you do not purchase insurance.

Covered by Insurance:

  • Breakage: Any form of the bottle breaking or shattering.
  • Non-Delivery: Packages not marked as delivered after 21 days.

Not Covered by Insurance:

  • Theft: Package theft from your home or business is not covered by insurance once the order has been confirmed delivered by the carrier. Please be available for delivery if this is a concern or have your package held by the Shipping Carrier for pickup.
  • Incorrect Address: Orders shipped to an incorrect address provided by the customer. Please double check the address before placing your order.
  • Bottle Variances: Bottles that differ in batch, year, design, photos, titles, descriptions, or other listing details are not covered. If these details are critical, contact us before placing your order.
  • Minor Damage: Slight leaks or seal/label damage during transit or packaging that we determine as minor is not covered by insurance.
  • Spoilage/Evaporation/FreezingProlonged exposure to extreme heat or cold (above 80 degrees, below freezing) may spoil wine and spirits. If you are shipping wine or spirits in extreme weather, we highly recommend choosing an expedited shipping method or requesting us to delay shipment until conditions return to normal. Wine or spirits being spoiled during transit and weather related spoilage is not covered by shipping insurance

Please take note of the following:

  • Don's Liquors & Wine is not responsible for breakage or non-delivery specified above if insurance is not purchased. For full protection against these risks, you must purchase Shipping Protection.
  • Do not purchase product if you do not agree to these terms.
  • Shipping carriers will not cover damages or lost packages any longer for alcohol shipments. Do not skip on purchasing insurance.
  • The option for Shipping Insurance shows up as a separate line item in your shopping cart at the time purchase.
  • In the case of a lost package, a 10 business day wait is required after the last update to deem a package as lost.
  • In the case product is damaged or is lost by the carrier, please immediately contact support@donsliquorsandwine.com with a description of the damage, photo evidence of the damaged bottle, photos of the box and photos of all packaging. Claims will not be approved without proper evidence.
  • Once the claim is approved, either a replacement order will be created OR a refund will be given for the cost of the product back to the original payment method used. In the event a refund cannot be applied, a store credit will be given.

Extreme Weather Warning

Prolonged exposure to extreme heat or cold (above 80 degrees, below freezing) may spoil wine and spirits. ​Adult Signature May Be Required

  • Our orders may require an adult signature.
  • You must be at least 21 years of age to order and a signature of someone at least 21 years of age is required upon some deliveries.

Shipping Policy

  • The customer is solely responsible for the shipment of alcohol and must abide by their local and state laws.
  • All orders placed usually ship out within 1-5 business days.
  • Orders placed on Friday after business hours, Saturday or Sunday will be shipped out 1-5 business days from the following Monday
  • Shipments may be delivered on Saturday or Sunday
  • We do not guarantee any shipping delivery dates; all dates are estimated.
  • We cannot ship to PO boxes or APO/FPO addresses
  • We do not ship outside the U.S.
  • We do not ship to the following states:
    • Alaska
    • Hawaii
    • Massachusetts
    • Tennessee
    • U.S. Territories

Interstate Shipping

All merchandise from Don's Liquors & Wine is sold in California and title passes to buyer in California. By placing your order, you authorize Don's Liquors & Wine to engage a common carrier on your behalf to deliver the merchandise to your specified address. We make no representation as to the legal right of anyone to ship or import wines into any state or country outside of California. When selecting to ship to another state, you assume all responsibility for determining whether you may lawfully import alcoholic beverages into that state. As interstate shipping laws are continually changing, please check with an appropriate agency before placing your order. Note that interstate shipments may incur additional taxes and tariffs from the final destination location. These additional fees are  the responsibility of the customer. 

Return, Pricing & Exchange Policy

We do not allow returns for any reason. We do not accept returns or exchanges for spoiled wine, spirit or beer. Changes in personal taste preferences or dissatisfaction with a particular wine, spirit or beer are not eligible reasons for return or exchange. Batch, year, bottle design, photos, titles, descriptions or other variances are not guaranteed to be correct in any listing. These listings are best effort additions but are not perfect and may include mistakes. Please contact us if any of the aforementioned are important to you before placing your order. If your item was delivered damaged, incorrect, or you received the wrong product, please contact at 408-225-2991 or email us at support@donsliquorsandwine.com and we will work with you to replace or fix your order when appropriate.

Cancellation 

We understand that sometimes plans change, and you may need to cancel your order. Please note, if your order has not yet been processed or fulfilled, you can cancel it subject to a 3% cancellation fee. Customer is also responsible for the cost of return shipping and the cost of insurance in the event the order is sent out by our warehouse. This fee is directly charged by our payment processing partners and, unfortunately, is non-refundable. We want to be transparent about this cost to help you make informed decisions when placing orders.

Returned Shipments 

It is the recipient's responsibility to receive the shipment in a timely matter including but not limited to being available for a signature and providing the correct address. If for whatever reason the shipment is returned back to sender, the outbound shipping fee is non-refundable. Additionally, customers will incur additional charges for the full cost of initial shipment AND, full cost of the returned shipment, and the cancellation fee (3%). Shipping carrier return shipments are costly so be careful entering the correct address and being available for the package.

Finality of Sales

All sales are final. We endeavor to offer competitive prices, and due to market dynamics, our prices may change over time. Please be aware that once a purchase is made, it is considered final. We do not offer refunds, credits, or adjustments for any price changes that occur after your purchase, including any price reductions or promotions that may follow. Occasionally, we offer promotions and discounts for a limited time. These special prices apply only to purchases made during the promotional period and cannot be applied retroactively to previous purchases.
